1. Acceptance of Terms

These Terms and Conditions ("Terms") govern your use of the services provided by ASHTA & CO PTY LTD (ABN 86 647 646 204, ACN 647 646 204) trading as La Cucina Melbourne ("we", "us", "our"). By making a booking, placing an order, dining at our restaurant, using our website, or otherwise engaging with us, you agree to be bound by these Terms.

2. Our Services

We operate an Italian restaurant offering dine-in and takeaway (pickup only) services. Our opening hours are 6am – 11pm every day. Menu items, prices, availability, and opening hours are subject to change without notice. We reserve the right to refuse service in reasonable circumstances.

3. Bookings and Reservations

• Bookings are subject to availability and confirmation.
• All table bookings are paid in full at the time of booking via PayPal ACDC Hosted Fields. Cancellations and refunds are handled in accordance with our Refund Policy.
• Please arrive on time. Tables may be released if you are more than 15 minutes late without notice.
• You are responsible for providing accurate guest numbers and any special requirements (including dietary needs) at the time of booking.
• We reserve the right to rearrange seating or refuse entry if the booking details are inaccurate or if the party size significantly exceeds the reservation.

4. Pricing and Payment

• All prices are in Australian Dollars (AUD) and include GST where applicable, unless otherwise stated.
• Payment is required at the time of ordering for takeaway (pickup) orders and at the time of booking for table bookings. For dine-in guests without a booking, payment is required upon completion of the meal.
• Online card payments are processed securely through PayPal ACDC Hosted Fields. We also accept other payment methods as displayed at the restaurant.
• A service charge or tip is not mandatory but is appreciated for exceptional service.

5. Guest Conduct

We expect all guests to behave respectfully towards staff and other customers. We reserve the right to refuse service or ask guests to leave if their behaviour is disruptive, aggressive, or otherwise inappropriate. Intoxicated guests may be refused further alcohol service in accordance with responsible service of alcohol laws.

6. Allergies and Dietary Requirements

While we take reasonable care to accommodate dietary requirements and allergies, we cannot guarantee that our kitchen is free from allergens. Please inform our staff of any allergies or intolerances before ordering. It is your responsibility to make your requirements known.

7. Intellectual Property

All content on our website, menus, branding, and promotional materials (including text, images, logos, and recipes where applicable) is owned by or licensed to us and is protected by copyright and other intellectual property laws. You may not reproduce or use our materials without prior written consent.

8. Limitation of Liability

To the maximum extent permitted by law, we exclude all liability for any loss, damage, or injury arising from your use of our services, except where liability cannot be excluded under the Australian Consumer Law. Our liability is limited to re-supplying the service or refunding the cost of the service, at our option.

9. Third-Party Services

Payment processing (via PayPal ACDC Hosted Fields) is provided by a third party, PayPal. PayPal’s terms and conditions also apply. We are not responsible for the actions or omissions of this third party.

10. Changes to These Terms

We may update these Terms from time to time. The current version will be available on our website or upon request. Continued use of our services after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of Victoria, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Victoria.
